Your Rights and Choices
The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.
Right to Know
You have the right to know whether we collected, sold, shared, or disclosed for a business purpose your personal information. You have also the right to know the specific pieces of personal information we collected about you (Data Portability Right).
You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. You may also be entitled to receive the personal information collected beyond the 12-month period, but not before January 1, 2022, unless doing so proves impossible for us or would involve a disproportionate effort.
Once we receive and confirm your verifiable consumer request (see Exercising Your Rights), we will disclose to you the information required under the CCPA.
As a verified consumer you can request to be sent the following:
The personal information categories collected about you.
The specific pieces of personal information collected about you (referred to as Data Portability).
The source categories from which we collected the personal information.
The personal information categories sold or shared, if any, and the categories of third parties purchasing or receiving that personal information.
The personal information categories disclosed for a business purpose, if any, and the categories of persons receiving that personal information.
The business or commercial purpose for collecting, selling, or sharing personal information.
To submit such request, you will need to reasonably verify your identity in light of the nature of the personal information requested.
You may submit up to two requests in a 12-month period.
Deletion Request Rights
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Your Rights), we will delete your personal information from our records, unless an exception applies.
We may deny your deletion request if retaining the information is reasonably necessary for us to:
Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between us and you.
Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
Debug products to identify and repair errors that impair existing intended functionality.
Ensure the physical safety of natural persons.
Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
Comply with a legal obligation or other applicable law.
Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Exercise a legal right, including exercising or ensuring free speech rights.
Correction Right
You have the right to request that we correct any inaccuracies in the personal information we hold about you, considering both the personal information's nature and processing purposes.
We will use commercially reasonable efforts to correct inaccurate personal information once we receive your verified correction request.
We may deny your request to correct if we determine that the contested personal information is more likely than not accurate based on all circumstances, including:
The nature of the personal information (e.g., whether it is objective, subjective, unstructured, sensitive, etc.).
How we obtained the contested information.
Documentation relating to the accuracy of the information whether provided by the consumer, the business, or another source.
If we are not the source of the personal information and have no documentation in support of the accuracy of the information, the consumer's assertion of inaccuracy may be sufficient to establish that the personal information is inaccurate.
We may also deny correction requests that:
Conflict with federal or state law or qualify for an exception to the CCPA.
Based on the circumstances, make compliance impossible or involve disproportionate effort.
We have a good faith, reasonable, and documented belief that the request is fraudulent or abusive.
Were previously made and denied within the past six months, unless the consumer provides new or additional documentation to prove the contested information is inaccurate.
Freedom from Discrimination
You have the right not to receive discriminatory treatment by us for the exercise of privacy rights conferred by the CCPA.
Exercising Your Rights
To exercise the right to know, correct and delete described above, please submit a verifiable consumer request to us at the email address or toll-free number provided in the Contact Information below. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. The verifiable consumer request must:
Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your pre-existing password protected account sufficiently verified when the request relates to personal information associated with that specific account. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request. You will be also required to re-authenticate yourself before we delete, correct, or disclose your consumer's data.
If you do not have a password-protected account with us, we will need to verify your identity to a reasonable degree of certainty, for example by matching at least two or three data points provided by you with data points maintained by us that we have determined to be reliable for the purpose of verifying you and depending on the request together with a signed declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request.
We will confirm receipt of your request to know, delete, or correct within ten business days and will inform you about the business's process for responding to requests, including our business's verification process and expected response timeframe.
We endeavor to respond to a verifiable consumer request in a timely manner and in accordance with applicable law. We will provide our substantive response within 45 calendar days from the date we receive a consumer's request to know, delete. If necessary, this term may be extended and you will be notified. The maximum total response period, including any extensions, is 90 calendar days.
We will provide the response and requested information free of charge, unless the request is manifestly unfounded or excessive.
If we maintain consumer information that is deidentified, we will not provide or delete this information in response to a consumer request or to re-identify individual data to verify a consumer request.
To prevent accidental and irrevocable deletion requests and to assure us that you made a clear choice to exercise your deletion rights, we may adopt a two-step verification process to exercise your deletion right. This could require that you first submit the verified request and then you separately confirm that you want your personal information deleted.
Changes to Our Privacy Notice
We reserve the right to amend this Privacy Notice at our discretion and at any time. When we make changes to this Privacy Notice, we will post the updated Privacy Notice on the Website and update the Privacy Notice's effective date. Your continued use of our Website following the posting of changes constitutes your acceptance of such changes.
